These terms govern your use of mutescene.com and purchases made from MUTESCENE. Please read them before using the site or placing an order.

About these terms

This website is operated by bover LLC, 30 N Gould St Ste N, Sheridan, Wyoming 82801, United States (“MUTESCENE,” “we,” “us,” or “our”). bover LLC is the seller of products purchased through mutescene.com (the “Site”).

The MUTESCENE name, trademarks, and associated brand assets are owned by Tianjin Yuandian Gou Cross-Border E-Commerce Co., Ltd. and are used by bover LLC under authorization. The trademark owner and other service providers may support product supply, fulfillment, creative, technical, or operational services, but do not replace bover LLC as your contracting seller unless we clearly state otherwise.

By accessing the Site, creating an account, or placing an order, you agree to these Terms of Service (“Terms”). Our Privacy Policy, Cookie Policy, Shipping Policy, and Returns Policy form part of these Terms where relevant. If you do not agree, do not use the Site.

Eligibility and accounts

You must have legal capacity to enter into a binding contract in your place of residence. If you are under the age of majority, you may use the Site only with the involvement and consent of a parent or legal guardian.

You are responsible for providing accurate, current information and for maintaining the confidentiality of your account credentials. Please notify us promptly if you believe your account has been used without authorization. We may suspend or close an account where reasonably necessary to protect customers, the Site, or our legal rights.

Use of the site

We grant you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Site for lawful, non-commercial shopping and informational purposes.

You must not interfere with the Site, attempt unauthorized access, introduce malicious code, impersonate another person, use false payment or delivery information, scrape or harvest content at scale, bypass purchase limits, or use automated systems to disrupt the Site or obtain an unfair purchasing advantage. We may restrict access, cancel affected orders, or take other proportionate action where we reasonably believe misuse, fraud, or unlawful activity has occurred.

Products and availability

We aim to present product descriptions, dimensions, materials, colors, and images accurately. Screen settings, lighting, photography, hand-finishing, plating, and the natural variation of pearls or stones may cause reasonable differences between the product shown and the product received. These differences are not defects unless the product materially fails to match its description.

Products and quantities are subject to availability. We may change or discontinue products, correct errors, and limit quantities at any time. Adding an item to your bag does not reserve it.

Products are intended for personal use. Commercial resale, purchasing on behalf of an unauthorized reseller, or attempts to evade quantity limits are not permitted without our written consent.

Orders and contract formation

When you submit an order, you make an offer to purchase the selected products. An order acknowledgment confirms that we received your order; it does not mean that we have accepted it. A binding sales contract is formed when we send you a shipment confirmation, unless applicable law provides otherwise.

We may decline or cancel an order before shipment for legitimate reasons, including lack of stock, an obvious pricing or product-information error, failed payment authorization, shipping restrictions, suspected fraud, sanctions or legal restrictions, quality-control concerns, or suspected resale activity. If payment has already been captured for a cancelled order, we will refund the amount paid to the original payment method.

Please review your order and delivery information carefully before submission. Contact us promptly if you identify an error. We cannot guarantee that changes can be made after processing begins.

Prices, payment, and taxes

Prices are shown in the currency selected or presented on the Site. Currency conversion may be approximate until checkout. The final price, applicable taxes, shipping charges, discounts, and other charges will be displayed before you complete payment.

You authorize us and our payment providers to charge the payment method you select. Payment may be subject to authorization, verification, fraud screening, and the terms of your payment provider. Your bank or card issuer may impose currency-conversion or international transaction fees that we do not control.

Customs duties, import taxes, and local charges are handled as described at checkout and in our Shipping Policy. Where they are not collected by us, you are responsible for them to the extent permitted by law.

Shipping, delivery, and risk

Available destinations, processing information, shipping methods, estimated delivery windows, and charges are described in our Shipping Policy. Delivery dates are estimates unless we expressly agree to a guaranteed date.

You are responsible for providing a complete and accurate delivery address. If a parcel is returned because of an incorrect address, refusal, non-collection, or unpaid charges, we may deduct reasonable return and re-shipping costs from any refund where permitted by law.

Risk of loss passes to you when the product is delivered to you or a person you identify, except where applicable law requires a different rule. Please report visible damage, missing items, or delivery problems promptly so we can investigate.

Cancellations, returns, and refunds

Eligibility, time limits, condition requirements, exclusions, return instructions, and refund timing are set out in our Returns Policy. That policy does not limit any mandatory cancellation, return, repair, replacement, or refund right available under applicable consumer law.

Refunds are generally issued to the original payment method after the returned product has been received and inspected. Original shipping, return shipping, duties, and taxes are handled as described in the Returns Policy and as required by law.

If a product arrives damaged, defective, or materially different from what you ordered, contact hello@mutescene.com with your order number and clear photographs. We may ask for the product to be returned so that we can assess it and provide an appropriate remedy.

Intellectual property

The Site and its content—including product and campaign imagery, video, text, graphics, layout, designs, logos, product names, code, and other materials—are owned by or licensed to bover LLC and are protected by intellectual-property laws.

MUTESCENE trademarks and related brand assets are owned by Tianjin Yuandian Gou Cross-Border E-Commerce Co., Ltd. No right or license is granted except the limited right to use the Site under these Terms. You may not copy, reproduce, modify, publish, distribute, frame, mirror, sell, license, or commercially exploit Site content without prior written permission from the relevant rights holder.

Reviews, feedback, and submissions

If you submit a review, photograph, comment, idea, or other content, you confirm that you have the right to share it and that it is accurate, lawful, and does not infringe another person’s rights. Do not submit confidential information.

You retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt, and use it for operating, improving, and promoting MUTESCENE, subject to applicable law and our Privacy Policy. We may moderate or remove submissions that violate these Terms or the law.

Privacy, cookies, and third-party services

Our processing of personal information is described in our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy.

The Site may rely on or link to third-party services, including payment, shipping, analytics, social-media, and commerce providers. Their services may be governed by separate terms and privacy notices. A link does not mean that we control or endorse all content or practices of the linked service.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the Site is provided on an “as available” basis. We do not promise that it will always be uninterrupted, error-free, secure, or free from harmful components. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, exemplary, or consequential loss, including loss of profits, data, opportunity, or goodwill, arising from use of the Site or a purchase. Our aggregate liability relating to a product order will not exceed the amount you paid for that order.

These limits do not apply to fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law. Your mandatory consumer rights remain unaffected.

Changes, governing law, and general terms

Changes

We may update these Terms to reflect changes to the Site, our business, or applicable law. The revised Terms apply from the effective date shown above. Changes do not retroactively reduce rights attached to an order already accepted, unless required by law.

Force majeure

We are not responsible for delay or failure caused by events reasonably beyond our control, including natural disasters, war, civil unrest, epidemics, labor disruption, government action, carrier interruption, infrastructure failure, or interruption of utilities or communications. We will take reasonable steps to reduce the effect of such events.

Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. The state and federal courts serving Sheridan County, Wyoming will have jurisdiction over disputes, except where mandatory consumer law allows you to bring a claim in another jurisdiction or requires different law to apply.

Severability and entire agreement

If any provision is found unenforceable, the remaining provisions remain effective and the affected provision will be limited to the minimum extent necessary. A delay in enforcing a right is not a waiver. We may assign these Terms as part of a merger, reorganization, sale, or transfer of our business; you may not assign them without our written consent. These Terms and the policies incorporated by reference form the entire agreement concerning your use of the Site and purchases from it.
